SMPD officer who provided false statements in the Reyes Family Arrest is being given paid administrative leave We have learned that Jaciel Cortina, the San Marcos Police Department officer who provided false statements in a sworn affidavit related to the arrest of Gerardo Reyes Gonzalez, has been placed on paid administrative leave. Let’s be clear: paid leave is not accountability. On March 14, 2026, San Marcos Police officers stopped a vehicle driven by 17-year-old Esteban Reyes after receiving a report that a 15-year-old girl had entered a red truck. That report was false. The girl had never left her home. No crime had occurred. Despite this, officers escalated the encounter. They ordered Esteban, a minor, out of the vehicle without clear justification. When he questioned why, they attempted to forcibly remove him. His father, Gerardo Reyes, a passenger in the car, did what any parent would do, he tried to protect his son. For that, both were charged with “interference with public duties.” After booking, Gerardo was transferred directly into ICE custody, where he remains detained at the T. Don Hutto Detention Center, facing deportation and separation from his family. Gerardo is the primary provider for his household, his wife is disabled, and his children are U.S. citizens. His detention has created immediate financial instability and deep emotional harm. Now, the credibility of this arrest is further unraveling. In his sworn affidavit, Officer Cortina claimed that “Gerardo repeatedly stated that officers would not be taking Esteban out of the truck.” But video from the encounter, recorded by Gerardo himself, shows no such thing. Instead, the footage shows a father trying to protect his son, asking officers why they are being treated this way, and repeatedly telling them that his son is a minor. A parent arrested for doing what parents do: protect their children. This contradiction is not minor, it goes to the heart of how this arrest was justified in the first place. It raises serious questions about truth, integrity, and the abuse of power. And still, Gerardo remains in ICE detention. Placing one officer on paid leave does not undo this harm. It does not reunite a family. It does not restore trust. We are demanding real accountability: --Drop all charges against Gerardo Reyes and Esteban Reyes immediately. --Release all body camera footage from every officer present fully and without redaction. --Release Gerardo from ICE Detention Our community has been watching and will continue to do so until we receive real accountability.
